You invest in great media to sell a listing, so it's fair to ask who actually owns it afterward. Here's how it works with us, in plain language.
Copyright vs. Usage Rights: They're Not the Same
Under U.S. copyright law, the person who creates an image owns the copyright automatically, unless a signed written agreement transfers it.
When Vibrant Real Estate Media shoots your listing, we own the copyright, even though you paid for the shoot.
What you receive is a license: the right to use the media to market the property.
Think of it like buying a movie ticket or streaming a song. You get to enjoy and use it as agreed, but you don't own the original work.
What You Get With Every Order
Once your order is paid in full, you receive a license to:
Use the media to market the property you hired us to shoot, with no time limit on that listing's marketing.
Upload it to the MLS and listing portals, and use it on your website, social media, email, brochures, flyers, and ads.
Share it with your seller, co-listing agent, and your brokerage for marketing that same property.
Keep showing the work in your own "recently sold" and past-transactions marketing, as long as it is clearly tied to that property.
What the License Doesn't Cover
You may not sell, sublicense, or distribute the media to any third party for their own use or profit.
You may not use the media to market a different property, or in a logo, trademark, or general brand advertisement, without an Extended License.
You may not remove watermarks or metadata, or claim you created the work.
You may not use the media to train AI tools or in datasets.
Light edits such as cropping for platform sizing are fine. Other edits, composites, or AI alterations need our written permission. Virtual staging and edits must be disclosed as the MLS requires.
Changing Agents, Relisting, or New Owners
The license is for the listing agent or brokerage that ordered the shoot, for that property.
If the listing expires or the property is relisted with a new agent or brokerage, the new agent needs their own license, or you may transfer access to them in writing for marketing the same property only.
Sellers may keep copies for personal, non-commercial use, such as a keepsake. They may not use them to market the property through another agent or as a For Sale By Owner listing.
Contact us for a quick relist license, which is often discounted.
MLS Rules & Syndication
Many MLSs require you to have the right to upload what you post, and some require a broad license from the photographer.
We grant you the rights needed to display the media on the MLS and the portals it syndicates to, for that listing only. Check your local MLS rules.
If your MLS requires a specific form of license, tell us before the shoot and we'll work with you.
Portals and the MLS may not sell the media or use it for unrelated purposes.
What About "Work for Hire"?
Agents sometimes assume that paying for a shoot makes it "work for hire," meaning the agent owns it. In most cases that's not correct.
Work for hire must be stated in a signed contract, and it typically applies to employees or specially commissioned works.
Our standard agreement does not transfer copyright to you.
If you need full ownership, ask us. A written copyright assignment is available as a custom option.
Extended Licenses & Custom Needs
We can license media for uses beyond a single listing, including:
Brand advertising and recruiting for your team or brokerage
Developer, builder, and stager use
Print campaigns and signage
Multi-property or ongoing marketing

Our Portfolio Rights
Vibrant Real Estate Media may display the media in our portfolio, website, and promotional materials. If you'd like us to keep your project private, tell us in writing before the shoot and we'll respect it.
Payment & Delivery
Your license begins when your order is paid in full. We may withhold delivery, or suspend or revoke the license, for unpaid balances.
Best Practices for Agents
Ask up front: "What rights do I get with these photos?"
Don't assume that paying means owning.
Don't reuse media on a new listing unless you're sure you have the rights.
When in doubt, contact us before reusing images.
